your employer is not willing to send you on T1, so why do you want to know if you can travel to UK on T1 if your T2 is rejected ? will it be for the same assignment or to look for jobs in UK ?

in my opinion if you apply for T2 visa your T1 will not be affected.

I once took out a business visit visa and came to UK while holding a T1 visa
and later on got a job in UK on T1.

Wait for more replies, someone may have faced the same situation as you

The question to be asked is
Why your employer is not sending you on T1 Visa?
Why your employer want to incur the cost of sending you on T2 Visa?

T1 is better than T2 and if T1 will still be valid then what's the need for T2?

Also I think if T1 gets cancelled if you go for T2, then you won't be going ahead with that option.. right?

For the first two questions...my employer is not intrested bcz the company rules won't allow him to send on Tier1 General visa....

So can u pls tell me

1)If we go for Tier2 my Tier1 gets cancelled or not....

2)If Tier2 is rejected still my Tier1 Visa will be valid or not....?

Any senior memeber Please help...?

Tier1 & Tier2 permits are similar where both allow you to work in the UK

getting a second permit, T2, will mean you dont want to live & work in UK so UKBA will most probably curtail your T1 & grant T2 as your circumstances have changed & you have chosen to remain employed with your company (& yourself) based abroad

regarding the company not willing to send you on T1, i think this is just a tactic used by them to tie you down on T2 visa where you cant jump ship to any other employer as immigration rules are being tightened where in the instance of you leaving your job, your T2 permit sponsored by the company will also cease

your Tier 1 can get curtailed irrespective of whether you get Tier 2 or not as you are not using it & have no intention of living and working in UK on Tier 1

Hi,

You can have only one valid resident visa for UK at one period of time.

For example, when I switched from work permit to Tier 1 in UK, I got a letter from UKBA, which states that the new visa granted to me completely supersedes my earlier visa and its terms and conditions.

Tier2 rejection doesnt affect Tier1 validity.

Tier2 approval will cancel any Tier1 validity.

Hope its clear
