ILR 10 years long Stay

Post by nanipals » Mon Apr 16, 2012 10:50 pm

Hi,
I am planning to apply for ILR based on my long stay(10 years). When I was a student at Uni in 2005, I applied for visa extension through University International office before my visa expires. They checked my application and submitted my visa before it expires. But unfortunately, my card payment was declined and the application was returned to university International office after 2 months. Univeristy International office asked me provide bank draft to resubmit application within 2 days. I gave the draft next day and they sent my application after 2 days. I got my visa and passport after one month. I had enough credit in my card.I dont know why my card was declined. As I was very busy with my PhD project, i did not bother that time as university International office was taking care of my application. But Now, Many people are saying that my application to ILR will be refused due to break of countinuous lawful residence. Can you please advise .

I hope you will be ok as you have applied for extension befor your visa expired. If the home office have refeused your extension and have given you an appeal rights then it could be a question mark. But in this case I hope you will get through.

Will it be considered over stay

Thank you for your reply. I have a small question. Will it be considered over stay as i dont have visa between end of feb and may. Will Home office consider the day when i applied for extension first time (feb) considered as my date of application or will they consider the day of my resubmission with another form of payment be the day of my application?
If they consider the second one, then i was considered applying for visa after my visa expiry date..
Please help me.Thank u for ur help.

Feb. Click on given links for more info. As you had responded within 28 days, you had not overstayed.

Thank you vinny. Do you think i need to get information from the university regarding the dates they sent my application, the date that they got back the application (due to payment declined), the date they send back the application and the date they received my processed application.

UKBA statements are very confusing. Could you please send me the links that you mentioned in your message.

Many Many Thanks for your help

Thanks alot Vinny. I am a bit relaxed. However, I dont have any proof that i submitted my application withing 28days. Univeristy of International Office people submitted my application after verifying all the details. I contacted them and they told me that they have no information regarding the date that they received my application back and the day that they resubmitted my application. I dont have any copies. I am pretty sure that i did not submit new application. They sent me a message saying " We Submitted your application on 25th Feb 2005, Your payment got refused and resubmitted again in April and Got back your processed application in May". I asked them to provide full details. They replied me to contact my legal advisors as they cant provide any information. I dont have univeristy email id now to check any emails that i received from them.
I am in a tough situation. Is there any chance that i can get the details . Univeristy International office is more unhelpful.
Please any one help me.

nanipals wrote:HI all,
I finished my 10 years in UK on 3rd Feb 2013. I did my masters,PhD and then PSW, now Tier-1 Dependent. During 2005, (When i just started my PhD), i applied for my visa extension through the University International office before the expiry date of my visa(28th Feb). As per SAR File , they rejected my visa application as no fee paid (card rejected). Then they returned it on 8th March 2005. I dont remember what happened that time, University re-sent my application back on 15th April 2005 and I received my visa on 16th May.
In case worker notes, it is shown like this:
Exceptions
Student Batch
01/03/05
allocated to ICC4
ppt.x1
XXXXXXXX(this is blank erased name) Unit:ICCDPT4 Date:2nd Mar 2005

List sheet indicates "No Fee Paid" therefore the applicant is sent to CST for further action

XXXXXXX Unit:ICC4 Date:07-Mar-2005

Application Returned
Card(Switch) rejected by bank
All docs(+ 1XPPT) sent to applicant

Form is Valid

XXXXXX Unit: CST Date:- 08-Mar-2005

RPP-Not Called for
Re-Sent to Applicant
XXXXXXX Unit: CST Date: 04-Apr-2005

I dont remember when my university international office had informed me regarding this problem. But i remember that i submitted another form of payment within a week after hearing from university international office.

I called univeristy but no use, they dont keep records of more than 3 years old because of data protection it seems. SAR is not clear .. In Dispatch details: it is showing that:
Despatch Method: Recorded delivery Despatched by User XXXXXXX
Despatch Address: Applicant Despatched By Unit: Charging Support Team
Outgoing delivery number: Despatch Date/Time
They gave two numbers here 08th Match 2005 12:05

As i applied through university international office, i remember that i received all communication through them only( including collecting my visa back from them). I need your advise with regards to my case. Will this issue affects my application for ILR under 10 year long stay. This is the only one time, i applied through university , all other times, direct appointments at either liverpool/birmingham/croydon. so no other problems. How to make my case stronger to get ILR. Please help me..

Thank you
