Appeal for spouse visa

Does anyone have an idea when will be my hearing date if the AIT have given the ECO until 10 january2006 to respond to my appeal ? Until now the ECO have not send the bundle?

Can my wife apply for visiting visa if the the appeal is on pending?

Probably not for ages......when we filed an appeal the ECO was given until 14th September by which to file. After which date the AIT gave them ANOTHER deadline for filing the bundle which was the 16th November (tomorrow). And I assume that now we'll finally get a hearing date which will probably be a few months away.

Hence why we filed a fresh application in the interim as the appeal process seems to be very long winded (although we haven't withdrawn the appeal as you can still reapply with an appeal pending)

With regards to your visitor visa question, there's nothing to stop you from putting the application in but you have to really prove that your spouse will return to their home country afterwards.

So are you saying you reapply again ahve get to be called for interview again and what was the outcome?

See my other thread for details.....but basically the outcome is that the second application has been granted and my husband now has his visa. We will withdraw the appeal now obviously as we don't need it anymore.

From my experience, the date for heareing will be set without prejudice to the feedback from the international post.

The documents in respect of my dependants appeal was forwarded by the High Commission in my home country a few days after the hearing in london. Incidentally, the AIT had sent a successful appeal letter to me before the overseas office replied.

In respect of a visit visa for an appeal settlement case, it is usually difficult to achieve success as it is not easy to prove that the applicant will return home after the visit.
