EEA2 Appeal help needed

Post by bravo187 » Fri Apr 27, 2012 4:15 pm

Dear all,

I just joined this forum and really appreciative of the advice and insights of everyone and would be grateful if i could get some help.

Apologies in advance for the epistle :)

My immigration history - i came here in 2008 on a working holiday visa and shortly before it expired i applied for EEA2 in 2010 as a cousin of a German national. It was refused on the grounds that i did not include my sponsors ID or passport and they weren't sure i was related to my sponsor as claimed which was incorrect as they lost the ID card and there were several proofs in form of documents sent to show how we are related. I sent a paper appeal and the judge agreed we are related but said there is no proof of dependency.

I then re-applied in October 2011 this time with the help of a lawyer and i included all the necessary documents but it got refused again in Feb. Although, I have have a lawyer but i am not sure i will be able to pay him to represent me in court because of his charges which is why i need help.

Well, the basis of refusal was in three points
1) my sponsor is self employed, so they want a company account, testimonials and accountant letter even though the application was sent with tax statement and an accountant's letter.

2) that there is no proof of dependency here in the UK and before i came here. In my application, i sent proofs in form of bills showing that we live in the same address here in the UK and several transfers to my account by my sponsor and also bank statements showing transfers he made while i was outside of the UK.

3). That when i first arrived in the UK in 2008, that there is no proof that i lived with sponsor; i didn't have bills in my name until 2009.

Based on all the above what do you think my chances are and are there any similar cases that have been won that i can read to help me with this appeal?

I would be happy to hear your opinions and suggestions.

Thank you :)

I suggest you fill those information gaps and appeal. If you can't come up with what they wanted from you, you need to say why you fail to do so, e.g. why did the sponsor pay you while you were not in UK? It looks like you hired him to pay you if you did not work for him while he transferred money to your account. I don't think that appealing has a specific format. Good luck and update us please.

Thank you for your response but i think you may have misinterpreted my post. When i said sponsor i meant my cousin who is an EEA national. I was dependent on him while i was in Nigeria hence, the money he was sending to my account. I then came to the UK as a working holiday maker and started living with him. Before my visa ran out, i applied as an extended family member of my cousin.
I hope this is more explanatory.
