When can i Qualify for ILR ?

Hi Guys,

I need to ask one question which I am very confused about.

I did get my Tier 1 (General) on 17th June 2009 and its expired on 17 June 2012

I have an appointment of 16th May for Tier 1 (General) Extension.


If I get the visa on the same day which is 16th May then my new extension I would assume would be until 16th May 2014.

So that means My Total Tier 1 (General) Period would be below:

17TH June 2009 Until 16th May 2014

- My Question is would there be any problem with ILR for me ? ( Do I qualify for 5 years ) ?

- When can I be able to apply ILR, in which month ideally ?

Did you enter the UK with your Tier 1 visa or did you switch into Tier 1 from inside the UK? For the former, you can apply for ILR no earlier than 28 days before the fifth anniversary of your arrival (whatever that date was); for the latter you can apply for ILR no earlier than 28 days before 17th June 2014.

I came to UK in 2006 as a student and then convert to PSW in 2007 and then afterwards i converted to Tier 1 General in 17 June 2009..

So if i get the extension of my Tier 1 on 16th May then would i still be able to qualify for ILR ?

you are eligible for ILR on 18th May 2012...if you go on 16th may they will give you visa from that date...so your visa will not complete 4 years 11 months and 2 days necessary to apply for ILR....dont apply for extension before 15 days

I think you didn't get my question, i am going for Tier 1 Extension on 16th May 2012 , NOT FOR ILR.

basically your 5th year anniversary is the 17th of June 2014, and you can apply for ILR no earlier than 28days before the 17th of June, I used date calculator and I make it the 21st of May 2014. So if you get an extension on the 16th then you will fall short by 5 days.
I suggest you go for a later appointment say the first week of June, this way you will have plenty of leeway when it comes to ILR

I am not too familiar with PSW, does it count towards the 5years at all? I presume not hence you are extending first

What do you think, would this help the situation..

You should be able to apply on or after 20th May 2014 if the current rule that allow one to apply 28 days ahead of completing the qualifying period remains in place.
