ILR for Main Applicant, while dependants continue on Tier 1

Post by indianleo11 » Tue May 08, 2012 8:58 pm

I came to UK in June 2007 on Work Permit and got Tier 1 General on May 2010 and got the same extended in Apr 2012. I also have two dependants on the same and the we all have leave to remain under Tier 1 till April 2015.

Now I want to apply for ILR BUT want my dependants to continue on the current Tier 1, which is valid till April 2015.

The question is whether my family will be able to stay in UK under Tier 1 Dependant while I am on ILR?

Yes. If not travelling, then they may remain in the UK as Tier 1 dependants. But your spouse/partner should switch to FLR(M) prior to applying for for settlement. However, why don't you all apply for settlement together when you all are eligible?
