UK Status Change

Post by Tat » Thu May 10, 2012 11:29 am

Hi to everybody!

I wonder whether anybody could give me advice what is best way to legally extend my stay in UK. My situation is as follows. I'm married to a EU person who's lived in UK for 6 years. He's been working all this time & has been paying taxes. We've been maried for 3 full years. I'm staying in UK on Work Permit which expires on Jan1st-2014. We have a 1 year old child who is British ( the baby was issued British passport on bahalf of her farther ). I know immigartion matters can take a lot of time to sort out, that's why I'm trying to get things organized in advance. I'm not sure whether my employer will extend my Work Permit, that's why I want to take care about my further stay in UK myself. As far as I understand I have got 2 options in my case:
1. Being a mom of a British child I believe there should be a way to get a kind of resident status with a right to work. If it is so, I'm not sure what to start with..I've tried to google this info, but havent been able to find anything appropriate..
2. Being a wife of a EU person i can get a EU Family Membership for 2 years. In my case I'm not sure whether i will be able to do that not leaving UK? I might need to go to my country to apply for this type of visa at the place of my residence...

I would appreciate any help/advice/idea!!

Thank you very much in advance for your time!

Tat

You already have residence rights in the UK as you are married to an EEA citizen and you can freely change your job to any other without the need to apply for sponship. You can apply for confirmation of your residence rights by applying for a residence card using form EEA2. You will be eligible for permanent residence after five years of marriage and residence on that basis.

How long have you been on the work permit? Are you still working under the terms of your work permit?

Thank you for your message! My Work Permit has been issued on Jan28-2009 & valid til Jan27th-2013. Its another1,5 years to go, but I know i should have a residence confirmed 0,5 year before the current one expires..I know I have got time, but i would like to get it sorted quite in advance anyway..

Thank you for your message & the link! Actually, I know the site you've recomended. I've beed to the page you've referred me to trying to look for some info in regards to my personal situation. Its ok i can apply for a residence card using form EEA2. I am just not sure whether i still can do it not leaving the UK. I've heard once from someone that being on Work Permit here I cannot change the status staying in the country. To do that i need to go back to the country of my residence... Have you heard anything about such like cases? What I can do I think - i can apply for a residence card using form EEA2 & see what they come back with?..
Thank you for help once again!

You may apply for an EEA residence card from inside the UK. Note that you may be eligible for PR 5 years after your marriage to a qualified/PR EEA national.

Yes, and furthermore, it's only possible to do inside the UK. It can't be done outside.

You should also be aware that you can hold a work permit and Residence Card at the same. Applying for one doesn't cancel the other (although having both is normally not needed).
