you have been given the answer, and a reference to the law. you cannot apply for leave to remain (i.e. from within the UK) as a tier 4 dependent unless you already have dependent leave, which you don't. therefore, you have to go home and apply for entry clearance, that is presuming your wife is studying on a postgraduate course that is at least 12 months long or that she is government sponsored (if she is not , then you won't be able to apply to be her dependent at all).

Guru, it's with regard of second question that if my leave as a student is expiring and her leave as well expiring as a student, if we both apply together at the same time for extension and i apply as a dependant. still i have to go back. please reply.

Thank you in advance.

with respect, we have already answered your question. Regardless of the fact that your wife will also be applying for an extension, you cannot apply from within the UK as a tier 4 dependent if you currently have leave as a tier 4 migrant. You have to apply for entry clearance.

what course is your wife studying?
