advice for a friend here for 2 years

Post by ban » Mon May 14, 2012 5:11 pm

I'm sorry for double posting something that has already been discussed.

My friend has lived in the UK for 2 years and currently married to a British person. My friend just passed the Life in the UK test and applied for Settlement.

Is my friend eligible to get ILR for living here for 2 years and onwards?

thank you. Your help is appreciated.

Everyone who applies in-country is given limited leave to remain. The question is under which category was she given that leave.

Thank you Sushdemhta for the fast response.

my friend is 2 year live under spouse

so basically what can my friend apply for? Settlement right?
but I thought we need to live in the UK for at least 3 years or 5 years to claim for settlement?

If she meets the requirements, she may apply for settlement no earlier than 28 days before the 2nd anniversary of her entry in the UK as spouse of a British citizen or settled person.

this is a classic example of why people should post their own queries rather having friends post for them- it appears you are confusing your friend. If he has a spouse visa then he can apply for ILR 28 days before he has completed two years in the UK in that category.
