Tier 1 Extension - Wrong Version of the form submitted

Post by hi2vandy » Tue May 15, 2012 5:13 pm

Hi,

I applied for Tier 1 extension one month back, today I realised that I have submitted the wrong version of the form. My visa is expiring tomorrow, and I have still not heard from UKBA till now. If UKBA returns my application after 15 days, when my visa has already expired ...would I be able to resubmit or I will have to leave ? Can anyone advice me if something can be done in this case ?

Thanks a lot

Vandy

The current version of the form was specified on 06-Apr-12.
On what date did you apply?

See also Applications made within 21 days of specification of a form.

Thank you so much for the answer.

I applied on 12th April, and did not realise till yesterday that I have filled a wrong form. The link mentioned by you states that an old application can be used till 21 days, but along with the wrong version of the form I have also entered the incorrect fees, as the fees also has been modified after 6th April

If UKBA returns my application after some time, and my visa has already expired ...would I be able to resubmit or I will have to leave ? Please advice me if something can be done in this case ?

An out-of-time FLR application should be accepted, I believe.

But for the purpose of settlement (if you are aiming for it) any period in UK without valid leave will reset the clock - despite leave being approved for an out-of-time FLR application.

Thank you so much for the answer. Can you please tell me that when I have applied for an out of time application, can I work or do I have to resign from my job ....My visa has already expired.

Thanks a lot for the help

You cannot work until your out-of-time application is approved. Until then, you are an overstayer and have no legal right to live / work in the UK.
