ILR after two weeks

Post by HKDK » Tue Jun 05, 2012 12:36 am

Hi All,

I came in May 2007 on work permit and in September 2009 I got my Tier 1 General. I would be applying for ILR along with my wife. So for almost 2.5 yrs I was on work permit and then rest of the time until now on Tier 1. Can you please confirm the below things for me?

Form link is - SET (O) - http://www.ukba.homeoffice.gov.uk/sitec ... o04091.pdf

Documents required :
12 months pay slip
12 months bank statement
12 months utility bills
Tenancy agreement
P60
Employers letter
Marriage Certificate
Original degree certificates

Should I need to give any document for my wife?

Also one of the member has mentioned about co-hab document. What is co-hab and do I need that?

Your responses would be highly appreciated.

Kind Regards

Cohabitation = arrangement in which 2 people live together (in your case, as a married couple).

Hi

One of the most important documents which I found missing from your documents checklist is the Life in The UK Pass certificate for you and for your wife both. A part from that Your documents checklist looks fine to me just wanted to remind you that as your 5 Year qualifying time perdiod is a combination of WP and Tier 1 G I would like to advice you that also keep your WP letter with you what you've got at the time when you've got your WP from the UKBA I've read quite a lot on this forum that it's normally asked from the CW if the applicant case for ILR is similar to yours and the other thing is that if you've changed your employer in your past 5 years than I would highly recommend you to have all of your P60's and also P45 documents along with you at the time of your appication.

For the Co-hab or Cohabitation documents I would advice you that you just need to have some documents with you which will be under your wife name and your name or a combination of your name and your wife name together for eg
  • You can have your wife DVLA at your address,
Your wife NHS card at your address,
You and your wife joint bank account statements,
Your wife individual bank account statements
You can have your your Council Tax bill both under your name.
You can have Utility bills eg gas, electricity, water both under yours and your wifes name or either one of the name prefereably your under your wife name.
just keep this thing in mind that Co-hab docs is the proof that you and your wife are sharing the same property and living together as a couple so this means that all the documents yours and your wife has to be posted at the same address for the last 2 years period you can select any 2 or 3 of them randomly for any random months I think that would be suffice.

Hope this will answer your question.

Please do kindly share your PEO experience on the forum.

Good luck for your ILR.

Thanks to all.

Yes I forgot to mention Life in UK test results document.

I have council tax bill on mine and my wife name and my wife's name is after marriage name where as water bill is with before marriage name.

Should this really matter as I would anyways be attaching my marriage certificate?

I would be applying my wife's ILR along with mine so do I have to fill seperate form for her or just SET (O) is ok?

Many Thanks

In a 5 yrs period I was on workpermit for initial 2.5yrs and rest of the time on Tier 1 General since September 2009. I have got below few queries for SET (O):

1) For Section 3 page 9 which option should I tick

Section A
Tier 1 (General) migrant (excluding applicants applying under the terms of the
HSMP Forum Judicial Review Policy Document)

OR

Section B
Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial
Review Policy Document
Work permit holder

2) I got my Tier 1 in September 2009. So can you please confirm which section should I be filling for my ILR:

Applications for indefinite leave to remain where an applicant has had leave as a Writer, Composer or Artist, Self-employed lawyer, or as a Tier 1 (General) Migrant under the Rules in place before
6 April 2010

OR

Applications for indefinite leave to remain where previous leave as a Tier 1 (General) Migrant was
granted under the Rules in place on or after 6 April 2010

I think its first option however please advice.

3) Salary score: As I understand we need to show the previous salary of past 12 months continuous or 12 months out of 15 month period. When I applied for my Tier 1 General I was on a different salary band and now I am on different salary band. Previously I scored 30 points for my salary however now because of the revised salary I am able to score 35 points now. So is this acceptable?

4) Age score: When I applied for Tier 1 General my age was less than 31 yrs hence I got 5 points for my age, but now after 2.5 yrs I am unable to score an points for my age. So this acceptable?

Many Thanks in advance

Hi

First of all I would highly recommend you to read through the Set(o) form and then try to raise questions after that it would more appropriate.

There's no set requirements for the co-hab documents as I already mentioned in my post previously. So any documents under both your name will be suffice.

You dont need to fill a seprate Set (o) form for your wife you just need to fill in the dependants section in your Set(o) form.

Hope this will answer your question.

Please do kindly share your PEO experience on the forum.

Good luck for your ILR.

1. Note use of singular tense
2. If you applied for Tier 1 (General) in September 2009, why are you unable to choose the right option.
3. Read FAQs for ILR - WP/Tier 1/Tier 2/HSMP holders
4. As above.
