iam i gonna be sent home with my daughter??

hello there, thanks for the wonderful job i check on this page each day but im a bit confused, im a family member of an eea national but we are separated and i dont know his wherabouts right now. in november i applied after the five yrs and in two weeks they returned my documents asking me to prove my 5yrs residence in the Uk and my ex since we havent legally divorced they wanted his docs proving hes excersing treaty rights. on 30th.dec.2011 i returned the documents with a covering letter but without my husband,s documents coz he said to me that he will never even give me a bank statement as we dont talk since the separation, i was 6months pregnant prior to separation my daughter is now 18months old but shes never heard from the dad and he refused to get her a passport. now my concern is, since i applied i never recieved certificate of application 3months ago i called home office and they confirmed having my documents im so stressed i dont knw wat to think any more so my question is, what could be the next step? why havent i recieved the COA? im worried please help me do you think they will send me back with my daughter since her father refused to coperate??? waiting patiently for your responce. thanks

Hi,

Just wondering what visa are you on currently ??
Are you from EU or non-EU country ??

This might already help you in your case.

Also, if you had your name in bank acc etc, I am sure if you request the bank about your older statements when you were part of that account, they should be able to give you the statements, and this would go for most documents I believe.

But a few more details from you would help to understand bit more about the situation.

hi there, thanks so much for taking your time and reply me yes iam from Africa which is outside EU, i came on a spouse visa then later i was given the 5yr visa wchich is family memmber of an eea national but it expired in november last year.

another thing, we never had anythning in both of our names to be quite honest i never felt it was necessary because i thought the marriage will last forver so i never thought about such things. hes a germany national and for now i dnt knw which visa im on since its the home office with my passport but the family member of an eea national visa expired last yr november. thanks and im looking forward to your responce

This is one of the answers in the 2nd link above. Because you were married to the EEA national and now, though the relationship has ended and you've have lived in UK for 5 years, I am sure you have some grounds of positive outcome, but we don't know exact case.

Hope you understand.

But go through UKBA website, they have most of the information for most varied cases.

thanks so much for your response, iv checked out the link on ukba and i might stand a chance fingers crossed i just dont understand why they never even bothered to send me the COA its now 6months. hopefully its gonna be positive outcome.

eve00, do you know whether your ex was actually exercising treaty rights during a 5-year period while you have been here? For example, do you know whether he was working and if so where?

Is your daughter automatically a German national (albeit one whose father won't assist in getting a passport), or does she have to register or take some other step to confirm her naitonality?

Have you tqaken any steps to locate your ex?

i contacted the germany embassy but they wanted the dad,s signature and his passport copy so i gave up cos he made it clear that he will never do anythng like that. i know that hes working but i don,t know where i tried to trace him but i couldnt coz even all his friends since they know whats happening between us two they are not willing to give any information to be quite honest i know nothing about his wherabouts.

i know he was working and hes still working but where i dont know iv benn tryng to find out about his job for the last 12months but i failed.

How does he supports his daughter? If at all he does.

Have you considered getting help from child support agency?

Perhaps that could at least bring about finding him.
