Advertising in Jobcentre plus

I am currently on a work permit( Business and Commercial) but due to a restructuring exercise i left my employer and sought new employment. I found a job (same position) with a new employer (who is a licence holder) through the internet( through a recruitment agent) and was offered the job. I applied to switch my work permit to the new employer under Tier2 General on March 19th and provided Biometrics on 23rd April. Now the UKBA have sent an enquiry asking if the employer had advertised the post with Jobcentreplus. I have been advised by the employer and the recruitment agent that they do not usually advertise at Jobcentreplus as candidates for this type of work is in fact head hunted or recruited through recruitment agents. I am now concerned if the UKBA will reject my application for leave to remain under tier 2 based on the lack of advertising within Jobcentre plus this. My employer issued the COS in end February and has patiently waited through the UKBA delay. Any one had a similar experience, please respond.

If conditions of the RLMT for the specific job / SOC were not fulfilled, the application will be refused.
