URGENT HELP - SETTLEMENT VISA FOR SPOUSE

URGENT HELP - SETTLEMENT VISA FOR SPOUSE

I successfully got my ILR on 28th May 2012 and now I want my wife to join me permanetly. She currently resides in the US and her working visa expires in August so will like her to process it before it runs out however I have the following issues that I would appreciate your advice on:

1. I applied for ILR as director of my company and on the spouse applicatioin form, they have an option for employed or self employed for the sposor and if employed they asking for details of employer including phone numbers. For the phone numbers should I use my mobile or house phone number or should I use the number of where am currently contracting but the problem is I work shifts so not always in the office.

2. I missed delivery of my biometric card last week and as such have to wait till thursday to have it re-delivered but as time is running out I will like her to continue with application so as she can book for her biometrics before I send the other documents however will the date on the biometric card be the same as the date I had my IRL which is 28th May?

3. Her contract ended about 3 weeks ago so she is currently unemployed will this be any issue. I have about £1,800 savings and she have a savings of about $10,000.

4. Our relationship started in January 2011 and I did invited her for a visit in February 2011 but as a friend and not on relationship basis but she was refused on the grounds that she was illegal and that she was not having any strong economic ties in USA. At that time she was a student and her visa too have not expired and she was also employed by her university as a graduate assistant. It was rather a mistake on the part of the case worker. We did not bother to appeal and I rather went to visit her in March. We eventually got married in August 2011 and I have since visited her every other month so a total of 4 visit in the last 8 months. Now will this refusal be an issue and the fact that she applied as a friend and now we married.

1. give your mobile number and if the form asks for a work number give it aswell but explain in ur atement that u do shift hours so ur not their all the time.

2. i dont know maybe someone els can help on that.

3. her being out of work doesnt really matter , its ur job they'll be looking at. ur savings alone dont sound too great but together u guys will be fine. also mention her work experience and talk bout her job prospects in the UK as the ECO will see her as a skilled individual who'll add her bit to society and to ur household.

4. as far as i know for a settlement visa her previous refusal shouldnt matter, but do explain it in details in ur app. uve visited her quite often thats great, make sure u put that down in ur app along with evidence i.e e-tickets, entry stamps pages from ur passport. also give them as much evidence of ur contact with ur wife as possible to show its a sustaning relationship specially after the wedding i.e phone bills, pictures from different occasions, skype chat logs etc..

Thanks so much Syma. For the Savings I have another savings account with about £1,400 so hopefully that should make a total of £3200. My salary and dividend earnings both come to about £2,900 each month.

However my other worry is when I applied for my ILR, my earning period was between 1st April 2011 and 31st March 2012. Will it be ok if my supporting documents are upto March 2012?

Forget about her immigration history and refusal; that won't matter. What is your monthly income?

My monthly earnings is about 2,900 thats for salary and dividend. But my main worry is

1.it mandatory to add my payslips and dividend vouchers ( they are signed and by me)

2. can I use my earnings for only the 2011 and 2012 financial year? (thats 1st April 2011 to 31st March 2012) - I have all the p60's, SA302 and Letter from accountant all confirming my salary and dividend.
