Spouse visa under the new rules

Post by zahid.ali.anwar » Fri Jun 15, 2012 11:52 pm

My friend is a beautican. She has started her business from mid April. Till date she has earned approx £4000. She is expected to get married in October this year. By the time next year in Feb or Mar her earnings will reach approx 22 K. My question is;

Does she has to show maintainance fund of 16K.
Does she has to wait for a tax return to be filed or she can use a chartered accountant to make her business accounts.
Is it mandatory to show 12 month of income or if the target is achieved in few month will allow for early application just like Tier 1 general application.

Pls advise.
The question is... to be or not to be....

page 19
h. In respect of paid employment, where the sponsor is in the UK, they must be in
that employment (at the required salary level) at the point of application and either
have been so continuously for at least the previous six months (at a salary
throughout at the level required) or have earned the required amount through
salaried employment in the 12 months prior to the application
. The same applies to
counting the applicant’s earnings from paid employment where or once they are in
the UK with permission to work.
so it seems u can apply as soon as u meet 18600 income.........

She will need to show income from self employment over the last 12 months matching the threshold. See category F -para 160 of the statement of intent.
