Please help

Post by snowflake007 » Tue Jun 12, 2012 6:46 am

Hello all,

My wife had her appointment in the VFS centre in india. she submitted all her documents but somehow just submitted only 1 month( recent most) bank statement, not the whole 3 month/6month period they usually ask for.

We have now tried numerous times but they are not entertaining our query on the phone or face to face, saying nothing can be done anymore and we should simply wait and if they need they will ask for more documents i.e. bank statements. I believe that will happen after we wait 47 days and then the application comes back rejected saying -reapply and repay!!

Is it necessary to have full 3 month/6 month statements? they have my 6 month pay slips though.. please advise what should we do now..

feeling completely lost and helpless
thanks for your help

Yes VFS is right about their reply to you. You can do nothing about your application once you have submitted it. The only thing you can do is wait patiently for any communication from BHC.

Yes it does say in the UKBA website that uou need to have "Statements covering at least 3 months". Please refer to this link:

MAA5 What evidence of maintenance is required?

I am not sure about the "6 month pay slips" you submitted. Maybe the senior members can clarify this.

But just hope for the best. Best of luck to you. :)

Please would be grateful for senior advice- Greenie/Sushdmehta..

Do we withdraw our application and re apply with all of bank statements?

I am a doctor in the NHS and have sufficient bank savings in that 1 pay slip( just didnt submit the last 3-6 month pay slips and also the letter from bank stating the date account was opened and balance)

We have submitted other evidence also that I get rent from property letted out, P60, and tax return of last year..

any advice would be greatly appreciated.

Payslips do not indicate your outgoing expenditure so it may not be possible for the ECO to determine if the addition of another adult consumer into your household will be something that you are able to afford without recourse to public funds. It's likely this application will be refused.

Thanks for your reply Lucapooka.

My 1 month bank statement shows a good bank balance...I presume seeing that, income evidence from P60, 6 payslips, rent I get from letting my property out, tax return of last financial year....would all of that not help? I just wish they keep some sense. we have tried to submit the other bank statements but now nothing can be submitted.

Do we Withdraw our application and re apply considering the wait can take us over the 9th july and into new rules if we have to reapply.

Please suggest. thanks for your time.

It's up to you. You can wait and, if refused, appeal with previous statements or you can reapply.

Can I just clarify something that a lot of people are worried about. The application date for a visa is the date of payment. If you apply on-line and pay anytime before July 9, your application will be considered under the current rules rather than the new rules. This is the case even if you apply and pay before July 9 but can't get a booking at the VAC to submit biometrics until after July 9.

Thanks again Lucapooka.

As of now, we fit well within the time before 9th July application and payment wise..sadly if our application does get rejected for such a simple omission like incomplete number of bank statements, then our time of reapplication would be more than likely 9th july...which means we would then be considered under new rules...:(( for reapplication)

1 query more is, if we get rejected and appeal..how long does it take for the appeal to get answered..and in that appeal are we allowed to submit more bank statements(i.e. further evidence) or they consider the appeal with the evidence thats already been provided to them. appeal would still be under old rules i guess?

thank you.

Appeals take up to six months. If something existed before the application was refused, it can be added to the appeal. You can't use bank statements dated after the refusal date but you can use statements dated before the refusal date. When an appeal is launched, there is a review by the visa post that mayshorten appeal times to 8 weeks if the requirements are subsequently met.

It all exists with us. infact we had arranged to submit 12 months statements( to be absolutely safe) but that didnt happen.

what do u mean by review by visa post?

all this seems quite daunting, first we wait for upto 47 days(current processing times), then appeal , that could take 8 weeks to 6 months!!!!

I would try Emailing the embassy directly to ask if they will accept the additional statements. You will then also have written evidence of your attempts to provide them with the information and a better chance of the eco overturning a refusal on review.

We emailed the embassy the very next day, saying bank statements were not submitted, please let us do so, but only got a generic reply regarding the same....

the VFS centre in delhi was entirely unhelpful- when my wife asked, what all needs to be submitted- all they replied was..."give whatever u wish"!!!!

So even you think it might get rejected/refused?..2 seniors thinking the same I suppose is a grave sign of things to come.
