New ILR Rule - Extension due in Sept

Hi,

My Tier 1 GM extention is due in Sept 2012, I will be apply along with my wife (PBS Dependent), she is just got dependent visa. This extension will give me 2 years visa and I would be eligible for ILR after that and my wife will also spend 2 year at that time.

Question is if I go for extension in Sept, will it change Rules for my wife ILR and she will come under new rules? or her visa will carryon with old rules ?

Thanks Sushdmehta,

I did read your mention link but I am still confused ... Could you confirm please:

1) When I will apply for Extension (Tier 1) with dependent, my dependent's application will consider as new application of "Leave to Remain" after 9 Jul 2012 and new rules will apply on my dependent application when we apply for ILR in Sept 2014?

2) OR she will get her ILR along with me in Sept 2014 when I complete my 5 years and she will complete 2 years as dependent.

Could some one please clarify that my wife visa come under the new rules. she got tier 1 dependent visa in Feb, 2012. we will extend our visas in dec, 2012 for another 2 years. i will complete my 5 years in Dec, 2014.

my question is
will she come under the new rules when we apply for FLR in Dec, 2012?

MR rehman seem u can understand english so to inform you when ur wife or your kids will come under new rule which starts on 9 july

thanks greenie. i read this like and it says,

as long as the application which resulted in the original grant of leave as a spouse/partner was made before 9th July 2012, the 2 year probationary period, and (for partners of settled persons) the current accomodation and maintenance reqiurements, will continue to apply.

by this i understand that my wife can apply with me at the same time for ILR in Dec, 2012.

am i right?

Sorry, I will be eligible for ILR in Dec, 2014. I am going to extend my visa along with my wife in Dec, 2012 for another 2 years. my wife currently is on tier 1 dependent visa expiring in Dec, 2012 at the same as mine. she got dependent visa in Feb, 2012 and came last week.

as per my understanding after ready your link, she will come under the same rules (2 years) and can apply with me for ILR in Dec, 2014. please correct me if i am wrong.
