What documents do i need for FLR (M)(Spouse or civil partner of a person present and settled in the UK) ? Please

Just hope OP is applying before 9th July and does know what changes are coming into force on 9th July.

For anyone to answer that question, he/she will need to know:

1. What was your immigration status before you applied for settlement?
2. What is your wife's current immigration status?
3. When did your wife enter UK for the first time and under which visa?
4. When does your wife's current leave expire?

Thanks alots Sushdmehta. i will complete my ILR In 7 th July 2012 (5yrs students+3yrs PBS dependent+ 2yrs Tier 4 dependent). my wife current visa ( Tier 4 student we got married over 4yrs). She entered UK in 2005 under the student visa. Her current leave expire in Nov 2012. Thanks again. i will looking forward ur answer and advice.

Given that your wife will be applying to switch from being a PBS migrant to spouse of a settled person, she will be subject to the new rules if the FLR(M) application is made after 08-Jul-12.

Best that she submits the FLR(M) application at the same time as you apply for settlement ... before 09-Jul-12.

Hi, sushdmehta. Thanks again ur valuable answer but we booked our tests ( life in the uk test and A1 level ) on 4,5 july. My false, i did not know the rules going to change after 9 july . Please advice me what shall i do? Thanks.

Option1:
Assuming you pass LITUK, make the two applications before the week ends (07-Jul) ... your wife's application without the A1 English test pass report. If you receive the test result before your wife's application is returned, send it to UKBA and hope that it would reach the caseworker before he/she makes a decision on the FLR(M) application ... and takes into account your wife's eligibility on the date of the decision rather than on the date of application.

Do note that if your wife's application is refused before the expiry date of her current leave, she will not be given the right to appeal. In such case, she will then have to apply afresh under the new rules.

Option2:
Apply under the new rules, after 08-Jul-12, after she has received the English language test results.

Hi Sushdmehta. I am very thanks to you and your advices, May i also ask you please. What does that mean (a new minimum income threshold of £18,600 for sponsoring the settlement in the UK of a spouse or partner)? Does it mean income (£18,600) only my income or with my wife income ? Please Kindly answer. Thanks you.
