ROA or Visa for my India born child?

Post by adrishta » Sat Jun 30, 2012 5:19 pm

Hi,

I am a British citizen by naturalisation and my wife is a indian citizen with a ILR. Our baby was born in India during feb 2012 and trying to bring her to UK. We had already taken a indian passport for her during June.

Due to immediate travel plans we applied visitor visa for her (with the intent of applying for ROA once at UK) - But it got rejected.

Now there is a confusion whether to go for a Right of Abode or Settlement visa .
we don't have plans for a long term settlement and may go back to india in couple of years - so i would prefer ROA certificate for her ...

Now the queries I have are ...
- UKBA website lists only settlement visa for children - Has anyone applied ROA instead and have brought the baby into UK?
- whether right of abode is allowed on a Indian passport holder ?
- any issues due to visitor visa rejection on further applications?

please provide suggestions as i want make my next application sucessful ...

Child may apply for a CoE-RoA.

Were you a British Citizen at the time of your child's birth?

Then the link provided by Vinny is relevant.

Just want to add that you will have to be patient with whatever route you decide to take. No process will be complete in a fly. I do not know ROE application waiting times in India.

You can also apply for your child's British passport in India. Once you have the passport, you will then have to get an exist permit from Ministry of home affairs, otherwise they won't let child out of India.

There can be all kind of ways. ROA, British passport, dependant visa then British passport in UK then OCI, British passport in India and exit permit. Its upto you what you want to achieve in the end.

Thanks Guys !

I have decided to go with a ROA application. Some doubts on the same ...

1. Is a Indian birth certificate valid or should i need to register the birth with embassy before applying?

2. Is my original naturalization certificate, marriage certificate and british passport copy - sufficient to prove the claim of ROA?
