FLR (M) Visa for Wife - Expired

FLR (M) Visa for Wife - Expired

Hi,

I am on ILR and I have applied for my wife FLR (M) visa in April by post.. Still awaiting for the visa..

Her original visa expired in May, so we had already applied a month in advance for FLR (M) visa before original got expired. I am hoping that we should get her visa as I have submitted all the documents and I am sure they are proper.

Fingers crossed, we should get visa, but just for information I thought I should keep the answer handy that just in worst case, if her extension get rejected due to any XYZ reason, then would she need to travel back to home country or can we reapply / appeal from UK only??

If a valid, in-time application was submitted then a your wife will be given the right to appeal if the application is refused.

An out-of-time FLR(M) application will not succeed as FLR(M) requires valid leave.

Yes, we had applied before her original visa expired. Her visa was expiring in May 2012, and we have applied in April 2012.

So, the application was in-time, but now as it's June-2012, her original visa is expired.. and hopefully expecting we will get extension, but as said for information wanted to know what happens if in worst case the extension doesn't go through.

So, you mean to stay, she wouldn't need to go back to home country and she can file appeal from UK itself and can stay in UK until the decision on appeal is taken?

Yes, her stay in UK will remain legal until all appeal options are exhausted, thanks to section 3C.

FLR(M) postal applications are taking 3-4 months to process at present.
