Confused regarding indefinite leave to remain for my wife

Post by khanjaan » Fri Jul 06, 2012 5:20 pm

Hi guys
I am applying for indefinite leave to remain on 10 years long residency my solicitor has advised me that when mine is in process she will apply for my wife visa as FLR M which is a spouse visa.I hold pakistan passport my wife holds a mauritian passport
I have been talking to a colleague who told me that when he applied for his ILR he applied same for his wife ILR.My colleague and his wife both indian passport
His status was work permit plus tier 1 general all together 5 years he hasn't completed his tier 1 general coz his 5 years were completed and his wife came to this country after 3 months of his arrival as a work permit dependent .
i am just wondering what the difference is.

Dependents cannot apply with the main applicant if ILR is based on long residency. However I heard that people normally post FLR(M) for the dependent with ILR application of the main applicant. Someone here might elaborate further.

when you are applying ILR on long residence basis (10 or 14 year rule) your dependants are not allowed to apply with you as its mentioned clearly on the form set(O), how ever if you apply under different category like work permit and tier 1 (hsmp) your dependants are eligible to apply for ILR with main applicants. thats the reason your friend and his family got ILR at same time.
hope you got the point.
