A riddle to be sol: Home student or International student?

Hi,

I have an Indefinite leave to remain (ILR) visa right now but I am not completely sure whether I will be considered a home student or an international student for a masters course starting in Sep 2012. I got the visa in April 2012. Before that I had HSMP dependant visa (Tier 1) since February 2007 up till April 2012. However I was in my home country because I had already began my studies there. The idea was to leave for UK at the earliest once I completed my degree there. I was in constant touch with my family who were living in the UK since April 2007. I had also been to UK from 12th May to 16th June 2008 during my vacations. I had no restrictions to work, study or live in the UK if I wanted to since Feb 2007, however in order to finish my studies in India I had to remain outside the UK. On my graduation I moved to the UK straight-away in June 2010. Please can you clarify whether I will be considered as a home student or not after reviewing the above mentioned details? I won't be needing a student visa in any case to study in the UK but I am hoping I will be classified as a home student. Can you also provide some links which can support my case during admission on the course?

Although the topic is same my case is actually very different. I won't be switching the my fee status in the middle of the course! I have not even applied yet. I just need to know whether I will be seen to have qualified the ordinary residence criteria (of three years) to be classified as a home student or not, especially in the light of my temporary absence (to complete study in my home country) in the UK.

Oh! OK. Yeah, I think in their case they must have been CLEARLY ordinarily resident (lived/worked/studied for three complete years) before they applied for their Uni courses. While I only came in UK in June 2010 however my first visit was in the May 2008. So if one considers my time in the UK from 2010, I have only lived for two years till date....but what I want to know is why can't my time in the UK be considered from 2007 or perhaps from 2008 (in which case I will be thought to have completed three years of ordinary residence; still keeping in mind my temporary absence from 2008 to 2010!).
