Hello Guys,

I am a British citizen and am planning to apply for ILR for my wife who is on the leave to remain in the UK as the husband, wife or civil partner of a British citizen or a person who is present and settled here.

We have sufficient evidences and letters related to the cohabitation period to show for the period of two years. My only query is that she went alone on a holiday to India last year on paid leaves (i.e. annual holidays you get from a company when you are employed) to visit her family for three weeks and I was here in the UK only. Although she is based here in the UK for the last two years and we have been living together, I was thinking if Homeoffice will check our immigration records, they might think that we didn't stay together for those three weeks although we have all the evidences to show that as she just went on a holiday.

Is it something I need to mention in the cover letter to explain Homeoffice about it as I read note 8 on the form which says "If you did not live together for any part of the 2-year period, tell us the reasons for this and whether you stayed in contact with each other during this time, and provide any relevant supporting evidence"

Please advise. Your help will be much appreciated.

You don't need to mention your wife's holiday in the application. Reasonable time spent outside of the UK is acceptable and 3 weeks is well within the limits.

Thank you very much for your help, really appreciate that.

Although it is the reasonably accepted timeframe, I am thinking If Homeoffice finds it out , they may say that we didn't mention it in the form as they say in Note 8 that we need to explain if we didn't live any part of the two year period. Does any part of the period mean any period i.e. three weeks in my case which I also don't think as you advised but at the sametime they don't give any clarity on the absence allowed however short it may have been.

Not sure whether I am thinking too much here, kindly advise.

You weren't living apart. Your wife was on holiday, which is entirely different.

If it helps to ease your concern, my husband visited family in Morocco several times during his 2 year probationary period, usually staying around 4 weeks each visit. This wasn't mentioned in his application for ILR as there was no requirement to do so. He now has BC. :)
