FLR M or Direct SET M

Hello Everyone ..

As per new rules of July 2012 please give your guidance ..

Me > Student 6 years, 2 year PSW, 3 years Tier 2.
I got my ILR 10 years on May 2012.

My Wife> Joined me as Tier 2 dependent on 10 Jan 2011.. she still has her Tier 2 dependent visa valid till Feb 2013.

We got booking for FLR (M) in one of the PEO on 23rd this month.

As the new rules came up.. Please advice

1. Should we wait till 12 DEC 12 ( it will be 28 days before she qualify as 2 years rules)

2. What form should we use ... SET M or something else due to publish.

3. Will there be Financial Requirement for SET M as current FLR M .. that partner need to income more than 18 k or so.

1. Welcome to the forum and read the following post where we are trying to find the same answer FLR(M) or ILR.
2. Both of us are in the same situation where husband/wife will or have completed 2 years as a dependent but not as a settled person dependent.
3. I am saying that even thou we have completed 2 years as a dependent, we still need to switch to FLR(M) and then ILR.
4. On the other hand, FAZ28 insists that we can apply for ILR without switching to FLR(M).

I went through your and Faz's conversations. I am on your side after reading all the home office link till now. Could you please suggest/comment me on the followings...

--We have booking in PEO on 23rd this month for FLR(M) ... what should we do?

-- Do we need to show new financial requirement if apply for FLR(M)? (Note: 1st visa as Dep of T2 issued on Jan 2011 from out of country)

-- Well at the end if we need to go through FLR(M) .. will the part of 2 years counted from PBS dependent for ILR?

1. You need to meet the FLR(M) requirements.
2. The form has both options on and i think you might want to check which requirements will apply to you as your last leave was Tier 2 which was a route to settlement and your wife also had a Tier 2 dependent leave which means that she wud qualify under this route for ILR.
3. Mine and faz situation is different to yours even our partners had acquired ILR under 10 years.

I got the same issue here, I can apply ilr next month based on 10 year rules, 7 year student and 3 year tier 1(g), my wife as my tier 1 dependent for the past 3 year. According to the statement, we can apply ilr through set(m), can u show me the link for that? many thanks
