9 Years in Uk, Combination of Student and Dependent Visa

hello all,
I am desperate regarding my situation and I cannot seem to have a positive solution from a number of solicitors.

I came in UK in April 2003,on a student Visa, was on this visa for up till 2006.
Got married in 2006, wife being from my own country, NON-EU.
I applied to switch to dependent Visa in 2007 , renewed as dependent ending in October 2012. my wife came in september 2004, and is still a student, with a visa ending in Oct 2012.

we are no longer able to renew visa anymore,I would like to know despite solicitors being unsure whether I can apply for ilr[set=o] on the 10 yr long residence rule, in my own right as i came before my wife, yet being dependent on her.
From Oct 2012 to April 2013, I have no clue what visa to apply for, and neither do my solicitors. They've mentioned discretionary leave, and said its likely to be refused.

Yes, you can apply once you have met the ten year requirement.
