Question About New Financial Requirement.

hello mates

my partner earns £1116 a month which is below the new rules for financial requirements, shud it b ok if i applied for spouse visa provided that we will live in her parents house which means she will pay no rents nor bills!!

on the other hand if the income is below the required £18 600.. is it necessary to have over 16k in savings?? i think that's jst too much !!!

You can live with family and not have bills but that supposed saving in your expenditure will not be discounted from your income requirement. Your actual income is below the benchmark. You have to earn that amount or have savings in lieu. Whether you spend all of this on accommodation, or some of this, or none of this is not relevant.

Lukapooka's right. You can live with family, but unfortunately you will still need to meet the £18.600 minimum income, regardless of your outgoings. Savings under £16,000 won't be counted. I can only sympathise.

Asalam alaikum. It may not be much help at the moment, but the legal reps opinions are that the new finance level will be challenged in the high court. The minimum age was overturned, although unfortunately it took time.

if we take into consideration the monthly salary of the sponsor which is £1116 + bonuses... what if the sponsor gets a part time job and earns the required monthly £1550 combining the incomes of the two jobs?? would that help the application??

Yes - but you require at least 6 months pay slips to prove the income.

The new rules regarding finance don't apply to you. You remain on the rules pre 9th July, so you don't need a minimum of £18,600 per annum.

test. You don't need the B1 English test, but you do need to pass the Life in the UK test

i still don't get why they set the saving threshold to 16k even if the shortfall is £500... and if u're earning £18,600 u're exempt from that saving?? that's jst crazy!!!

anyway i wud like to noe if it is against the law in the UK to work 7 days a week!!! (5 days in one job and 2 days in another) jst to meet the financial requierement!!!

if not... is it possible to work 5 days a week in one position and get a part time job on 1 day/week working 12hours??

It is not illegal to work 7 days a week in the UK.

You just need to check the hours worked correctly. If your total weekly hours are under 48, you should be fine. Otherwise just sign the opt-out deceleration.

It is possible to work 7 days a week and combine a full time job with a part-time one. Harv posted before me...with a much better answer.

Hi,

Just need a clarification on my case.

1. My spouse is currently living in the UK under Tier 1 dependant visa from April 2012 hence she is currently a resident in the UK. Does post July 12 rule apply in our case?

2. My income is way above £18.6k so that is not a problem. But what is this saving thing of £16k? I will be applying for ILR via SET (O) this year.

3. My wife will be applying for FLR (M) and me SET (O). Is there funding requirement for SET (M)?

As far as I know you come under the old rules as your wife was already present in the UK on a dependent VISA.

the savings does it have to be the last 6 or 12months?also if what at the current work you get 14k and get another part time job, how long do you need to wait to apply? could it be anytime once u reach the 18k or do they calculate the average earning per month.

u need to prove earnings of 18k for the last 6 months!! so combining the two jobs u will need a period of 6 months to apply!!

Yes and that's a Gross amount before tax. So in reality you will be getting a little less after the tax.

Your monthly payslips however show both Gross (before tax) and Net (after Tax and NI)
