I figured we need a time line for appeal process, as someone who got refused I know the panic and confusion that comes with it.

This forum has been great and filled with support and understanding. I would like this topic to continue to the trend and allow applicants to share stories and updates


I can start with mine, I have just sent out my appeal documents today and will continually update it with any new info

Thanks Bill, How come you are appealing, surely for that sort of refusal you should be re-applying because if the home office did not receive your missing documents then your appeal might fail?

I think appeal is the best way to get my passport back with Rc otherwise HO can refuse visa again ,I also want to go for a hearing otherwise you know how unlawfully they refuse applications with no logic behind.The documents I sent with the eea2 had enough evidence but instead of asking some more evidence they kept my passport and told me to leave so I thought the best possible solution is to go for appeal I can not trust HO anymore.

According to them, I am not exercising treaty rights because I have not produced enough evidence of self-employed status (we did not recived back most of docs regarding that). On the other hand, they state there was not enough proof of cohabitation (despite rental agreement underboth names was enclosed). A solicitor has told us cohabitation is not even a criterion?!

MONIQUITA. as you are married i dont think proof of of cohabitation matters marriage certificate is enough but if not you have to evidence your relationship not only by rental agreement. the most important thing is that the eea exercise his treaty right and with the HO it is sometimes difficult to demonstrate that the EEA is self employed. Which docs did you submit?

The marriage certificate was submitted with the EEA2 application, so was the rental agreement. For the self-emplyed status, we submitted bank statements, monthly invoices, monthly remittance notices from the third company through which I am self-emplyoyed, Self-assesment of the tax return, including the on-going budget payment plan and paid National Insurance Contribution Bills. Also, I got a letter from that third company stating I work as self-employed through them and including other details of my services. As I said, that letter along with 21 invoices were never returned (which means they got missing by HO), we only got back three and refusal letter states that we sumbitted only 3. Surreal!

im sorry to hear that, they are extremely incompetent. The problem is how do you prove you submitted all those documents that went missing!
If you can then you have a case for appeal.

If it makes you feel better our application was rejected because they stated we had a marriage on convenience. They stated that at our wedding neither my wife or I could communicate with each other, neither party had any prior knowledge of each other and even had the audacity to say that we needed an Interpreter. We have a video of us doing the vows that proves all those accusations are lies, not only that but my parnter and I have a multitude of documentation (bank statement,holiday tickets,utility bills, call history, pictures,videos etc) going back all the way since 2010

Not only that but the report that claims all these accusations came about on teh 19th of June, the very deadline day for them to make a decision. It cannot just be a coincidence.

So you are not alone in feeling harshly done by, may I ask if your partner or yourself are from an african background, according to my solicitor that has a say on their decision even though by law it shouldnt

Thanks for your solidarity I read about your case and it is
unbelievable how dishonest HO stuff can be. It makes me anger the easiness with which they can create such lies,twist facts or making things up. No one should trust them after knowing cases like yours or mine,it is appalling and a disgrace. Yes, I was born and raised in Spain,yet my family migrated from Western Africa and my husband was born in Western Africa.
May I ask you about your approach to media? Did you finally do it? I.think the more cases come to light the better to make them react.

hello
i need some information guyz. i come from amsterdam with wife she is eu citizan . our marriage 3 years old almost .
i applay my and my wife eea1 and eea2 same time in march.8/3/2012 and thay send my all documents back 10/4/2012 with 1 latter which writin we need which category you applay
then again i make every thing all avdance and i apply as a salf-sufcet and job seekers and i send them all kind of proof's on 18/4/2012 .
and still am in waiting
i not get any reply . i try to call them and in phone thay told me wait we dont no any thing
so what i have to do ?

I did end up going to the media but I was politly ignored.

At the moment my priorities are getting my case sorted

anything else can wait till after my case is resolved

quick update, I have got my appeal paid and the payment HAS gone through. I am awaiting a court date.

The lady on the phone advised me to email Customer.Service@hmcts.gsi.gov.uk

quoting where I am entitled to a refund. If they agree they will issue a refund

it takes 2 weeks for them to manually update their system to say that u paid

You need to write to them now saying your entitled to a refund because it can take up to 2 months for a refund to go through

once they can see a payment is made then it takes a week for a date to be set


The date will then be a minimum of 3 weeks later so you are looking at 4 weeks + 2 weeks for payment to go through = 6weeks

ust received our bundle but the report as suspected was not included, the bundle the home office sent to us just included a quick summary of our application with copies of our application and passport

I am very interested in this fabricated report, our appeal is going to be held this Friday and I will keep everyone updated
