Tier 1 Dependent - July 2012 Rules

Post by hammad.77 » Sun Jul 22, 2012 1:34 pm

My wife has to apply for her first tier 1 application from outside the country. I understand she has to stay with me in UK for 5 years in order to qualify for settlement. I will qualify for settlement in 2014. I have following questions?

1) What would be the duration of her visa? Is it same as main applicant?
2) Secondly if it is same as main applicant then what would be the next step? She has to apply for FLR?
3) Thirdly is there any constraint that the dependent has to join the main applicant in the due course of time?

Many thanks.

only change is that dependent will now have to spent 5 years instead of 2 year to qualify for ILR

Couple of more questions:

1) Do we have to get marraige certificate attested if it is in English?
2) Secondly UKBA site states: 'You can apply for a visa up to 3 months before your date of travel to the UK'. Does this means we can not apply more than 3 months before the date of travel?

1. It has to signed by marriage Registrat..go to your local tehsil office (if you are from India) and they would do this for you..

2.Yes thats true...why would you need to do that..The turnaround time is 1 month ..why would you want to apply before 3 month...

I want to apply my wife visa in somewhere around Aug-Sept time and she is planning to join me in December. It is to get everything in place before time. What do you mean by turnaround time?

What would be the implications if I apply more than three months in advance? Are there any risks?

According to UKBA guidelines if you apply the visa you would need to travel within 3 month from the date it has been granted otherwise your visa might be considered as invalid...

Just called UKBA helpline and the lady told me that there isn't any requirement of travelling within three months of initial grant of visa. Dependent can join main applicant as long as their visa is valid.

Anyways thanks for your time.
