Regarding SOC code for Tier-2 ICT Visa Extension

Post by arpit.tayal » Fri Aug 10, 2012 11:39 am

Hello all,

I am currently in UK on Tier 2 ICT Establihed Staff granted under rules before April 2011. I am in UK since October 2009.

I am due to apply for my Tier 2 ICT visa extension next month.

I would like to know if the job SOC code on the CoS can be different than the one on CoS for the previous grant of leave.

Please advise.

Regards,
Arpit

The SOC code in the new CoS can be different from what it is in your present CoS since you are making a new grant of leave application.

However, be aware that if the SOC code changes during T2 leave a change of employment application has to be made and the sponsor would also have to report this to UKBA. See paragraph 189 of the T2 Policy Guidance.

Manci, as I understand from your comment: The SOC code on my this extension application can be different form the SOC code on my current leave. But once I am granted extension and then if there any change in job SOC code, this needs to be applied as 'change of employment application'. Right?

yes, that is correct. Presumably the SOC code change will occur at the time of the extension application, which is OK. If it had occured beforehand, and it wasn't reported, questions may be asked.
