10 years long residency

Hi All,

It would be really appreciated if anyone can advise me on my questions below:-

1. I came in Uk as student visa. Date of issue:-24/09/2002 Valid until 31/10/2005. I came in Uk on 04/10/2002
After that I was renewing my visa until 14/09/2009 as student visa.
On 14/09/2009 i was given HSMP visa on Tier-1 general and valid until 14/09/2012.

Now, i am planning to apply my ILR on 10 years residency.
On which date i am elgibile to apply my visa.(ILR 10 years), as i been in this country as legal.

2. Another, questions is regarding SCHENGEN visa. I have visited France in 2003. date of issue: 11-04-2003 and valid until:-10-06-2003.
But when I came to dover I have to pass through my immigration they have stamp on my visa but there is no stamp of date at that time.

Am I suppose to mentioned about this in application form.

I have asked for my SAR, but they havent sent me any acknowledgement letter and I can't fully rely on it.

Please guide me on this urgently.

Waiting heavily for reply on this.

Your 10 years count begins from the day you entered the UK (4/10/2002). Based on that start date, your 10 year period is completed on 4/10/2012. But your current leave expires 14/9/2012. So on the day you complete your 10 years, your current leave would have expired, unless you get an extension or a new leave.

So, technically you do not have enough leave to cover your 10 year period.

Your SCHENGEN visa and entry/exit is non-issue at this stage, so I would not worry about it.

You can apply for ILR based on 10 years legal stay up to 28 days from 4 October - so you are able to send your application on or around 6 September.

I have read on guidance note. I can apply 28days or within 28 days which means, any-day after 06th September 2012. Is it not true?

That is true. But what is 6th Sept 2012 based on? If it is based on your 10 year completing on 4 Oct 2012, then the same guidance would have also said '10 years of lawful stay'. How are you going to meet this requirement if your visa expires on 14 Sept 2012?

The key (or the problem) here is 10 years of lawful stay because if you don't play this right your clock will reset and you will lose 9 years 11 months and 10 days of legal stay.

Iam in same problem, due to apply ilr jan 2013, in one occasion i traveled to germany on schengen visa on 7 days trip, but there is no exit/entry stamp (calais to dover entry), i checked my emails, banks statements, old tickets but no chance of getting any help from those.

I am thinking to put any date from visa approval date to 7 days. Is that ok ?

Have you got your ILR ?
What did u put for the absence dates ?
