Tier 2 ICT -Long Term to Tier 2 General shift

I went to several threads but was not able to get convince myself with appropriate answer

Q:- I am in UK since May 2012 via Tier 2 (ICT) Long term with validity till May 2015.

I have job offer from UK company but i am not sure if i can shift to Tier 2 General. They have offered salary more than 50K.

- Am i eligible to shift my visa to tier 2 g with new sponsor?
- do i need to be back to my home country to make a shift?
- If i can shift to tier 2 G, what are steps?

Any more input much appreciated.

Hi

I think since you obtained your Tier 2 (ICT) Long term after April 2011 you cannot switch in country.
Also you might need to wait for 12 months in your home country to switch

Hi

That is so, and the new company (if they know the rules) would be aware of this because if they assign an unrestricted CoS to you, you will not be able to use it.

I don't think you have any options to shift as the visa rules were tightened up completely in april 2011.
To remain in the UK you need to continue with your Tier 2 ICT

Is the case same if the extension of tier 2 (ICT) has happened.
I got tier 2 (ICT) migrant in aug 2009 and then the extension happened in aug 2011 inside UK and my current visa is Tier 2 (ICT) Long term staff.

Can I switch to Tier 2 (General) now?

Since you previously had T2 ICT leave under rules in place before 6 April 2010 you can switch to T2G.

But today i have got a information for a frieend of mine who came to UK in March 2011 on Tier2 ICT and now got his visa converted to Tier2 General from ICT.

Could you please if you are sure that within country we cannot switch Visa

Check rules applicable from April 2011 onwards.
