Unmarried Partner Visa, salaried employment for less than 6

Post by pickles » Tue Aug 14, 2012 8:40 am

Hi, I'd like a little advice and clarification please.
My partner and I are applying for the unmarried partner visa.
She is a Canadian citizen and has been living here (youth mobility visa) with me for 22 months, I'm British, before this we were living together in Japan for 18 months.
Last year I undertook a PGCE (teacher training programme) I wasn't earning, but I did inherit 12,500 and lived from that (as well as a student loan).
She works at a nursery and earns approx 10,000 a year.
I now have a job (begins in September) teaching secondary English and will earn over 21,000, she is still in employment.
We have about 2,000 in savings.

Am I right in thinking that, according to, "5.3.2 Category B: salaried employment for less than the last 6 months"
First, where the applicant’s partner and/or the applicant (if they are in the UK with permission to work) is in salaried employment at the date of application and has been with
the same employer for less than the last 6 months, the applicant can count the gross
annual salary at the date of application towards the financial requirement.

Second, the couple must in addition have received in the 12 months prior to the
application the level of income required to meet the financial requirement applicable to it,
based on:
The gross salaried employment income of the applicant’s partner and/or the
applicant (if they are in the UK with permission to work);

• The gross amount of any specified non-employment income received by the
applicant’s partner, the applicant or both jointly;

Do we apply, does my inheritance count as non employment income enough to float my girlfriend's 10,000. does the fact that I begin employment in September count as gross annual salary at the date of application?

All advice gratefully accepted.

Also is there a helpline for this sort of question?[/b]

Ok - lots of questions in there:
does my inheritance count as non employment income enough to float my girlfriend's 10,000
Not based on my interpretation of the evidence. The evidence requires you to show the INTEREST from the savings, and that's the income, not the savings itself.
does the fact that I begin employment in September count as gross annual salary at the date of application?
Yes - BUT - it doesn't negate the fact you have to show the £18,600 level for the 12 months previous too.
Also is there a helpline for this sort of question?
I'm afraid they are called immigration lawyers.

I don't believe you qualify at this point based on your income levels.

I appreciate that won't be good news.

M.

Interest was made on the 12,500 inheritance though, it was in the bank earning interest. Or are you saying I need to have made approx 8,000 in interest alone?

The latter - the interest - e.g. the income - would have had to have been £8600.

I hate it when the truth hurts so much.
Thank you for your help.
