Hi everyone,

Just wanted to share my PEO experience while making ILR application today.

Date of appointment: 15th August 2012
Time: 8AM

Number of dependants: 1 (baby aged 5 months, my wife wasn't included since she hasn't finished her 2yrs in UK. She should apply for FLR (M))

Visa category: Set O (2 years HSMP + 3years Tier 1 (General) )
HSMP approval date: 10-Sep-2007
I arrival in UK: 28-Oct-2007

Reached Croydon office by 7:05, doors opened by 7:30.
Security check: 07:40AM
Passport check: 07:50AM
Biometric details recording: 08:10AM
Biometric details collection: 08:25AM
Met CW Worker: 09:10AM
ILR approved: 11:05AM

I had been working as a Contractor since I arrived in UK. Hence I had to provide all limited company documents.

CW asked for the following supporting documentation:
- Payslips
- Dividend Vouchers
- Personal bank statements
- Business bank statements
- Accountant letter
- P60s

- Photocopies (above docs & passports)

Additional info provided:
- Limited company docs (since CW asked me whats the nature of the limited company, do you own it etc). Hence I have provided her Incorporation certificate, VAT reg certificate, VAT returns etc
- HMRC Employment History
- List of absences from UK ( in my case they were 105)

Since me and my baby were applying for ILR excluding my wife. She clearly asked the reason, requested wife's passport copy and a consent letter confirming that my wife has no problem in UKBA issuing ILR to the baby along with her father.

After submitting the required documenets, we were asked to wait for 1.5hours. CW informed us that Biometric cards should be with us within 7-14 days.

Why you have included your baby with you as I can see you can directly apply for your baby british nationality after get your ILR?

Now what you will do with your wife application? FLR(M) or FLR(O)? and you are going to apply by post ?

Our baby was born in India and she is on Tier 1 (Dependant) visa currently. I don't I can bypass ILR to apply for Citizenship.

That's fine.
I’ve called UKBA and they told me that after getting main applicant ILR – you have to have apply for your dependent visa (FLR(M)) in next 28 days. You should apply for your wife visa in 28 days by post or in-person.

Congratulations!

Can I ask - Did your HMRC Employment history letter contain any amounts paid as dividends? (I am presuming the p60's did not)
Did you provide dividend vouchers going back the entire 5 year period to prove economic activity over the whole period?

Hi,

No, HMRC letter didn't have any Dividend amounts specified.

I have provided Dividend vouchers only for the 12 month period.

One more question, were u paying NI or any question on NI related issues ? . I have been paying NI and for last 5 months , I reduced my salary for paying some tax and NO NI, will this be an issue ?

Hi Raju,

No, I haven't encountered any questions in relation to that.

As far as I'm aware, Income Tax & NI are directly proportional to your Salary. Correct? As your salary grows, Income Tax and NI contributions also increase.

As a matter of fact, for the financial year 2012-2013 I haven't started making NI contributions yet.

i can see you have used 28 days from entry clearance visa and not the date you entered in the UK
Is it because your no longer had visa or just because u knew the rule
I have same dates as you n my current visa is expiring in october, i have booked appointment for 29th august but an adviser told me i cant apply with my EC date rather i have to use entry date

As you mentioned

HSMP approval date: 10-Sep-2007
I arrival in UK: 28-Oct-2007

So you entered in UK after one month and 18 days after getting HSMP visa, right? Case worker didn't ask any thing for that? did you mention anything in your covering letter why you did enter after one and half months? I know there is a rule that case worker may consider this period in 5 years duration time. My case is exactly same I got HSMP visa on 11 Sep 2007 and entered in 28 Oct 2007. I have booked my PEO service on 29th so was thinking if I should mention in covering letter why I entered late? etc.

My other total absences are 135.

Hi Sam,

CW did not ask me any question about the initial delay. I did not specify anything in the Covering letter, moreover CW did not bother to look at it anyways.

I think there is a waiver of around 90 days which might be of rescue to you.

I felt they were more interested in the absences since you have first entered in UK.

I don't see any problems with your application. Just 1 piece of advice from my side. Please try to mention the list of absences in a separate spreadsheet if you can. CW will find it easy to assess the situation.

was your visa expiring or u had enough visa to complete 5 yrs minus 28 days as per uk entry date
on another post some1 is suggesting that only if u have no more visa to cover on entry date than only entry clearance visa date is used n 3 months rule is applied

I want to ask similar question as above.
My situation is my visa granted on 8 Oct 2007 and I enter on 23 Oct 2007.
I called home office and they said the earlist time I can apply PEO is 25 Sep 2012.
It looks like if you enter UK more than 28 days later of the visa granted date, you can apply for PEO 90 days before the visa date. If within 28 days, you have to apply 28 days at the earlist.
Can anyone answer my question?
