Can my wife freely travel with me to EU?

Post by ofb1988 » Thu Aug 16, 2012 8:41 pm

Hi all.

sorry to clog the board up with this post but my head is about to burst with all the info i have been reading and i feel no wiser to what im researching.

Heres the situation -

Myself - UK born

My wife - Ugandan, currently on a 2 year visa after marriage.

She has a red and blue card with her details, a chip on the back also.

This card states type of permit - spouse/partner leave to remain and expires 23/11/2013

What i want to do is surprise her with a 2 week holiday to the EU, portugal, spain or germany most likely.

But what i dont know is if she needs to pay for a visa, if so what visa and so on.

I read if the card states shes a family member its ok but then i read this red and blue card may not be the correct card?

She has a valid ugandan passport also.

If anyone could clear this up for me id be grateful. called UKBA who didnt seem interested and were no help at all.

Your wife will have to apply for a schengen visa from the UK consulate of the country in which you choose to holiday. As the wife of a British Citizen, the visa should be free. Unfortunately it will be difficult to surprise her as she'll have to apply personally. :?

i emailed the portugese one, they list documents required and one of these is a booking for a holiday?

god knows how id get that before a visa as i wouldnt risk the loss.

For schengen visa's they generally accept the travel plan which includes intended train/flight, hotel booking with address and the number of days you will be staying there. I.e. you can show an online printout of the flight details for the flight you intend to take & hotel booking (you can book one that has no cancellation fee, so that in the event you do not get the visa you can cancel without a loss), without actually purchasing. I'd be surprised if the Portugese consulate do not allow you to do this, but you can contact them to verify what they specifically mean by "Holiday Booking" for clarity if you like.

If you intend to visit one of the “Schengen Countries” on business, as a tourist or on a personal visit, you must first obtain a Short Stay Entry Schengen Visa which is valid for all the Schengen countries and which enables you to visit any or all of the above mentioned countries and move freely in all of the Schengen Countries during one trip within the validity of the visa. A Schengen Visa is not appropriate if you wish to remain in a Schengen Member State for longer than 3 months in any six months or take up employment or establish a business, trade or profession. Apart from the short stay entry visa there are 2 other types of Schengen Visa: Airport Transit Visa which allows holders to pass through the international transit zone of an airport of a Schengen Country without giving access to the national territory of the Schengen Member Country. Transit Visa which enables applicants to pass through the territory of one or more Schengen Member Countries on their way to another country,
Please note that the documents required for both the Airport Transit Visa and the Transit Visa may differ from those required for the Short Stay Entry Visa.

HOW TO APPLY FOR A SHORT STAY ENTRY VISA

Where to apply for a Schengen Visa:
If you wish to visit only one Schengen Country you must apply for the visa at the Embassy or Consulate of that Country. If you wish to visit several Schengen Countries you must apply for the visa at the Embassy or Consulate of the Country of your main destination. If you intend to visit several Schengen Countries but do not have a main destination you should apply to the Embassy or Consulate of the first Schengen Country that requires you to have a visa. Visa applications are only accepted if the applicants are resident in the United Kingdom.

This seems to corelate with what I mentioned in my previous response. You just need a provisional booking of flight & hotel accomodation. I.e. you don't need to pay for these before your visa is issued. Note that as far as accomodation goes, if you are not planning on booking a tour using a Tour operator or travel agency then all you need to provide is a hotel booking.

If you want to get the best deals then yes, you may need to book and pay early. So it is a matter of what you feel in terms of taking a risk.

I have in the past booked tentative hotel accomodation selecting hotels which don't charge a cancellation fee via http://www.booking.com/ purely for the visa application process. I'm not aware of the same for flights, so the only option there is to provide the iternary by searching for flights that match your travel dates online choosing the airline you are most likely to travel with, then printing out the page which summarises the flight details and cost without actually paying for the tickets. Submit the hotel & flight plan printouts with the visa application. Once you get the visa you can choose the travel package you want (you may need to show this to the consulate when collecting your visa), but like I said you may find it more costly if you wait, as package holiday deals appear and disappear quickly.

If your circumstances are straight-forward & you are confident that your wife's visa will be approved then you could decide to book and pay in advance. The choice it yours.

Thanks mate.

Wifes record here is clean.

Attended college and gained a diploma, went home for 9 months when visa ran out, returned on 6 month visa for marriage, now on 2 year leave to remain.

She's working, gaining incomes, paying taxes etc etc.

I would think it would be fine.

Thanks for the help.

Ryan
