Tier 1 Extension OR ILR?

Hi All,

I came to UK on HSMP (later Tier 1) in Feb 2008, although my visa was stamped in Dec 2007. Have a couple of queries:

1. Since I came to UK 2 months after my visa stamping, I will not complete 5 years in Dec 2012. Can I still apply for ILR?

2. My wife has a separate Tier 1 Visa (not a dependent Visa) but she came to UK one year after me. Now if she is currently not a dependent, can I still apply for ILR for both of us together?

You can apply for ILR in December (no earlier than 28 days before the date your visa was issued). Your wife is currently independent of you and can't apply until she has made 5 years on her current status.
