I am currently working for my employer in Dubai. He plans to setup a branch in London and employ me there as a technical consultant. Here is a brief of summary of the case:

1- The employer is a British national, he will setup the new company in London

2- Can the new company immediately qualifies for a license to sponsor?

3- We sell a highly custom piece of software that was developed by our company, so there are no candidates in the UK who can fill this role. What does he need to do to prove that he could not find local candidates in the UK

4- My salary will be 40K a year but 50% will be paid in the UK and 50% to my bank account back home. Will this be an issue? Will we have to submit salary slips as prove of payment?

When your employer sets up a company in the UK he can apply for a sponsor licence but it is a lengthy process. It currently takes 4-5 months from the time the application is submitted. General guidance on sponsorship is here:

If at the time your employer gets his licence you worked for him for at least 12 months overseas you can be assigned a Tier 2 intra-company transfer CoS and then apply for entry clearance. In this case a resident labour market test would not be required but there are various other requirements regarding the job, the salary, etc.
