Can I work overseas (canada, USA) whilst sponsored on Tier 2

Post by ontopdownunder » Tue Aug 21, 2012 4:33 pm

I have been sponsored on a Tier 2 visa for 18 months and now my work would like to post me overseas for 6 months.

Is this allowed under the conditions of my visa?

Would I need to let immigration know?

Thanks in advance.

Assuming you continue to be employed by your existing UK sponsor, that is okay, but if you stay out of the UK for more than 3 months you will break your residence for the purposes of settlement. Obviously if settlement after five years is not of particular interest to you, then this should not be a problem.

Ah great, didn't realise there was a distinction made between the two.

Thanks for the heads up, much appreciated.

If your work location changes this must be reported both by your sponsor and yourself.

See the sponsor guidance para 556 d)IV

and the Tier 2 policy guidance para 210.
