I got my HSMP approval letter on 3rd October 2006 and visa on 6th November 2006, due to some reasons I left the UK and came back to UK on (arrived) 19th September 2007.

I have to apply for second extension to gain qualifying period of 5 years. My current visa (Tier 1 General) is valid till10/10/2014.

Since then I am continuous living in UK till date. So my qualifying period of 5 years for ILR is completed on 19th September 2012.

I believe we can apply 28 days before the qualifying period. So my family is approaching PEO Croydon on 24th of August 2012 for ILR, because we are planning to travel next month, I am including my daughter in the application.

I got two dependents (my wife and daughter). Both of them got the dependent (Tier 1 General) visa till 10/10/2014. My daughter born in UK.

To be on the safe side we have already wrote the LIUK test.

Questions:

1. I believe I come under ILR judicial review. Please confirm.
2. I also believe that we don’t have to submit the LIUK test result. Please Confirm.
3. In the application form (Set O 7/2012), in section 3 – Category - page 9, section B, which one should I select Tier 1 General migrant applying under HSMP judicial review policy document or HSMP under the terms of ILR judicial review policy document.
4. I believe I don’t have to fill the section 4 - page 28 - knowledge of language and life in UK. Please Confirm.
5. In section 11 – Documents - page 42 – which one should I select 11 G or 11 H.
6. In the guidance note (page 3): It says ILR judicial review applicants are only till 3 April 2006. Please confirm.
7. As I said earlier my daughter born in UK and have HSMP dependent visa till 10/10/2014 , but still I am applying for her ILR dependant so that she will come under main applicant category and because we are travelling. Is there any rule that says that I can travel with her without switching the dependent HSMP visa to ILR dependent visa. Please Confirm.
