1. I entered the country on student visa in SEp 2005
2. Visa was for 3 years, I finished my undergraduate in 2 years and done my MSc next.
3. I extended the studen visa in order to finish my thesis, the extension was approved and got student visa till 31st of August 2009.
4. I got engaged to my british boyfriend in 2009 and applied for COA (Certificate of Approval).
5. the COA was approved on 26th of August and booked the Ceremony for 1st of October 2009.
6. I applied for FLR(o) and my 2 reseaons was to a) recieving the sponsorship latter from Imperial College London as I registered as a PhD studen and b) get 2months extension in order to register the marriage.
7. I havent heard anything from home office so after 5 months I send a letter to Home office to know the status of my application and also i sent them my marriage certificate and asking them is it possible i amend the FLR(o) and apply for FLR(m)
8. after 2 weeks I recieved a letter. the caseworker told me that according the immigration rules( exact wording) i am eligible to apply the FLR(m) and he asked me to fill the enclosed form and send it back before 12th of April 2010. Also he said we dont require any further documents.
9. I send the form on 15th of March, and recieved my passport on 22nd of April.
10. the stamp was issued on 19th of March and nothing was written on my stam except NO ACCESS to PUBLIC FUND. Also i didnt recieved any letter with my documents.
So on 24th of Feb I applied for ILR(set(m)) in PEO. the case worker ther told me i have the wrong visa. He said the stamp in the passport is not the Spouse visa and he said you have apply by post.
so I sent my document on the same day to HO and recieved the aknwoledgement letter on 29th of Feb.
Today, as i was searching the UKBA website I came across the LOTR policy. But I am not sure if this is actually what my visa was!!
So confused and also sad because I had no idea that I didnt have the FLR(m). I still have the letter from case worker which stated that he can issue me with FLR(m) in immigration rule.
Your case to me looks complicated and it seems there was a mixed up somewhere between you and Home Office. but am not an immigration expert, but what I do know if truly they want to issue you Leave To Remain as a spouse as at that time you will need to have your Biometric taken and the LTR will come as a Biometric Card with Spouse written on it.
