Plz Advice

Post by farhan_81 » Sun Sep 02, 2012 2:32 pm

I am in UK from last 8 years on student visa and still have a valid student visa which will take me to 9 years 10 months, As i did my previous extension from a private college I was not giving permission to work, so my question is if i bring my wife on a student visa on a HTS or government funded college and switch my visa and become her dependent will I still be eligible to apply on long 10 years residency ?????? your advises will be highly appreciated

Thanks

Requirements for long residence
The applicant must meet the following requirements, in order to be granted indefinite leave:
[] The applicant must have at least:
-- 10 years lawful residence in the UK,

Also, "Once an applicant has built up a period of 10 years continuous lawful residence, there is no limit on the length of time afterwards that they can apply. This means they could leave the UK, re-enter and apply for settlement based on a 10 year period of continuous lawful residence they built up in the past."

Can’t switch visas in-country mate, you have to leave and apply EC abroad.

Student dependent / point based dependent does count in long residence, so does legal stays in other categories.

If you manage to get Dep visa from you home country then yes it will make yours 10th Anniversary for ILR.
