Tier 2 General Re-Applying After Refusal. Need Suggestions

Hi Guys,

I need some suggestion. May be some body can help me.

I applied for Tier 2 General Recently. My case was very straight forward. I got refusal on 20th August and the letter stated that

"Your applicatioon was made on xyz date. However,from the detial included on your certificate of sponsorship, your prospective employment is deu to start on xyz . Your application was made more than 3 months before the start date of your prposed employment.

We have threfore been unable to award points for Sponsorship.

I was not given right to appeal and got pretty confused.

When spoken to my employer, i found out that there is a field in certificate of sponsorship called "Work Start and End Date". He thought work start date is equal to the
date when my current leave expires( i am on post study work visa). He said that he was not sure what to put there. ( This really made me annoyed but that is another story).


I am submitting a new application now but my sponsor still do not knows much and is confused.

Can some one let me know

a- What do we put in the field called work start date and end date.(btw I am already working with company from last 1.5 years). My current leave expires in December 2012 so we are almost applying again now.

If we put start date as my psw end date, then i cant apply 3 months before that( is it correct)? If we want to apply now, what do we put in that date. My employer thinks that we can put any date which is within 3 months from the date from when certificate is granted.

As i have already got a rejection because on this stupid and small mistake, i don't want to take a risk so though some one will throw more light on what the employer fills in this field.

b- Now in my visa where it says have you ever refused entry? I have to select yes but I am not sure in explanation what do i say? I know the reason but do not know how to state it. Above I have exactly quote the reason for refusal given in my refusal letter, so can some one tell me in proper terms what do i put there based on reason specified above?

c- Do I have to attach previous refusal letter or I just have to state reason and they will work out automatically?

I am applying on Wednesday , so If some one can assist I will be extremely helpful.

Took money of application

Sent me a biometric letter

Let me wait for seven good weeks and then send rejection

This is the reason for rejection which I have finalized , is it ok?

The Visa Entry for Tier 2 General was refused because the COS (certificate of Sponsorship) was assigned before the 3 month time limit of the work start date of the certificate. The reason for that was that an incorrect ‘work state date’ was specified by sponsor in COS as this field was misunderstood by sponsor to be the ‘current visa/leave Expiry Date’. Hence, I was unable to obtain points of sponsorship and the COS (certificate of Sponsorship) was declared as 'invalid'.

As you have already submitted the application withdrawing will make no difference as the fees is non refundable. You can give a try by adding sponsor note about chaning the work start date from SMS. If your lucky you will get through

Sponsorship management system

Ask your employer to add on note on SMS requesting UKBA to change the start date in your COS ,to a date within next three months for your COS to be valid, otherwise you will gain no points for your sponsorship.One of the condition for assigning a COS is that the start date entered has to be within 3 months of assigning the COS

You know what is so funny that different people treat it differently.

In my company 3 people applied with same mistake.

TO first one, a lady sent a letter that i am processing this application but the start date has a problem can you please tell me to change it to a date within3 month. My sponsor replied with a date, she changed and my colleague got visa.

In my case, i got refusal.

THere is a third fellow whose application is still pending. My sponsor has last week went onto portal and add a comment that please while consider this appilcation cosider that due to an administrative issue, we have enter an invalid work date pleease change it to xyz.

His decision is pending. Lets see what happens.

Your colleague who got the visa is my friend and we were discussing the same situation. I don't know what will happen to my application. really confused with my situation.

dont know if they will consider the start dates based on the additional notes.

I have gone through your post and got couple of question in my mind if you guys can help me plz as any advise will be highly appriciated.

1. Does any of you know how long does it take or took you company to get the sponsorship license?

2. I am very confused about this start and end date business after reading your post.

here is my case.

My employer is going to apply this week for sponsorship license (My Visa is Expiring on 15 January 2013) I doubt it very much they will be able to get the sponsorship license before my visa expires. (Another story this will be)

But IF they get the sponsorship license and when they assign me UNRISTRICTED COS (as i am on PSW visa) As I am working with same employer from last 2 months now.

So for example

If they get the sponsorship license by January first week.

they will Issue me unristricted COS in first week of January 2013 in that case what will they put as Start and End date in my COS, As i am already working with them from August and by January i will have 6 months of working with them so will they put start date from Janurary ??? and than will calculate 2 or 3 years (whatever length of period they want to sponsor me) from January 2013?

please advise guy your help will be highly appriciated and gud luck with your case.
