visiting but previous refusal

Hello

me and my husband have decided that we'll apply for a 6month visitng visa however he has a previous refusal for a student visa because his sponser changed his mind and instead sponsered his brother to go to China.

However on the refusal letter the sponser said he had no idea how my husband had gotten hold of his financial documents despite there being an arrangement that he'd sponser my husband. My husband has no written proof of any correspondence between them.

I'd like to ask will that affect his application for a visiting visa, help much appreciated.

It seems like the UKBA thinks the documents your husband supplied were maybe fraudulent.

You would need to double check the passport, if they have stamped it with a 10 year restriction to any new application. If that is the case, I am afraid it will be a straight refusal. Otherwise you may have a chance to get a VISA if the UKBA has simply refused the original Student VISA.

I would imagine UKBA still has the relevant information about your husband on their database, so they will know the history as soon as they see his passport.

hello thanks for the reply, my husband has found some proof that they have had a contract however both he and the sponser share the same name,

also there is no where on his passport showing he has been banned from applying for 10 years,

I have a feeling the emigration clearance officer will suspect that he obtained these documents fraudulently despite there being an agreement, how will my husband prove that the sponser was genuinely sponsering him but changed his mind, replying much appreciated.

You cannot.

You need to explain yourself first and add evidence from the sponsor that he did what he did. If the sponsor is not complying then the only option is that you explain your side of the story. After that it is upto the officials to decide.

will this affect his chances of applying for a spouse visa if he is refused a visiting visa?
