Hello,

I need some advice please.. My case is:

I have been overstayer in the UK from 1999, and i came on a visiting visa. I have been with my partner UK born citizen since Jan 2010, but we only have proof of living together since April 2011. we have a baby girl now since 3 months. when UKBA tried to search for my details they could not locate me on their system.

I was served immigration papers to be detained and removed, but i wasnt and i didnt appeal as advised by my solicitor at the time, because i was on remand in prison for a case which was found not guilty.

Since the case finished i have not heard from UKBA, i thought my previous solicitor put a case for FLR(O) but we later found out she didnt and only made reps which UKBA have not even received, as we called and they have nothing. I NOW have gone to another soliticitor to apply for FLR(O), i just need some advise as what can happen if it is rejected? appeal rights?

My partner has put a claim for tax credits as she is on maternity leave and they have asked for me to be added to the claim, even though i have no status... and they informed my partner that i will have to go for an interview for a NI Number, can anyone advise of this aswel, what happens if i dont get NI number? will tax credits still pay?

Please help, any advice will help
