EEA Resident permit

Don’t know if i can have answers to few questions,
Am married to EEA member, i currently holds a resident card which expires October 2014,i entered into the UK in November 2007 meaning November 2012 will make it 5 years I have been living and working in the UK.
My wife arrived January 2008 been working with same firm since then.
My son who’s in Nigeria is due to arrive in October with EEA family permit stamp.

My questions are,
(1)Can i apply for permanent residence by November, taking into account my wife will complete 5 years in January?
(2)Will my Son be qualified to apply for Resident permit as well?
(3)Can my wife apply same time with me or wait till January
Any answer will be well appreciated, thanks all

MY EEA Resident card will expire October 2013

Your EEA status depends on your wife. That would make it January for both of you because she has to demonstrate that she was exercising treaty rights and have been resident in the UK for a continuous period of 5 years. Your son needs to be younger than 21 or dependent on you.

My child is 14 years old,does that mean he can apply for Resident permit in January as well?Thanks for your response

You can apply for a Residence Card for him on form EEA2 any time after his arrival. Your wife will need to show that she is exercising treaty rights or is a permanent resident. For practical reasons it may be good to do all that in January.
