Can you get Student Visa after 2 years of PSW Visa

Can you get Student Visa after 2 years of PSW Visa

Hello,

Its a question about my cousin who came in UK as a student in 2006. He has done his graduation and master degree from UK and then he got PSW in 2012 for 2 years.

Please if someone can provide answers of following questions:

1) Can he convert his VISA before expiring of PSW to student again by taking admission in another Master Degree within UK (means he does not need to go back to Pakistan)? I heard that you cannot become student again if you are already in UK for 5 years? Does this rule apply to him as he is here since 2006?

2) This question related to first one that when he will apply for student visa he will be in "UK" for nearly 8 years? Will it be any issue or problem that Immigration Officer can raise concern that he is applying for student again to complete his legal 10 years so that he can get "ILR"?

3) Can he also become a dependent if his wife is in UK as Student. If 'Yes' then does he need to go back to "Pakistan" or can he become dependent while he is UK before expiring his "PSW" 2 years visa?

4) If he legally live in UK for 10 years then will he be able to get "ILR" easily?

I am sorry for asking so many question. I hope someone reply on these question will help many others.

Yes there is a 5 year limit. You need to have a look on Para 87, 88 and 89. Plus there is academic progression rule according to new law.

Yes, if you can think like that, Immigration Officer too.

Depends on many things. I think best thing to go back and apply with main applicant same time.

No. He will destroy all his immigration history and may be deported with 10 year ban.
