Post by softmind82 » Tue Oct 02, 2012 8:21 pm

I have applied ILR few months ago and awaiting decision but i want to prepare my self for the wife and children visa ..... please advice me on the following.

My wife is staying with my parents back home due to their health and she lived in the UK for 3 years .... Her Tier 1 dependent visa expiring on 15th of this month and need to know if she can apply ILR once i get mine or do i have to get through with the process again? if so then what documents should i needed to show including financial.

I will be apply my kids registration as a British citizen as well back home, can i apply this as a joint application as a same time i apply for my wife...

Please advice.

1. On what basis have you applied for settlement?
2. Is the child UK born?
3. Is you wife returning to UK before her current leave expires (15th of this month)?

I applied under 10 years category and my children were born in the UK and wife not coming back until 15th of October but have plan in november. Therefore need to apply again.

Your wife may be subject to new rules if she makes an entry clearance application after 15-Oct-12.

There is no point in suggesting which category she should apply under because your status on the date of entry clearance and travel matters.

Your UK born child(ren) may apply for registration after you are granted settlement and then may apply for British passport.

If she will be applying for entry clearance as spouse of settled person, see Annex FM 1.7 - Financial requirement.

5.3.1 Category A: salaried employment for the last 6 months
Where the applicant’s partner and/or the applicant (if they are in the UK with permission to
work) is in salaried employment at the point of application and has been with the same
employer for at least the last 6 months, the applicant can count the gross annual salary (at
its lowest level in those 6 months) towards the financial requirement.

Is that mean i am permanent salaried employed with the more then 6 months at the company so i could show the 6 months payslip and that gross will be taken into account ? for example my gross from april till october is £16000. would be alright for them to calculate the rest of my salary until 31st march ...

is it gonna be ok for if i apply within my 6 months salary confirming by my employer.

Thanks
