Tier 1 depended and its refused based on not supplying TB

Hi,

I have applied for my wife visa for Tier 1 depended and its refused based on not supplying TB medical certificate.

I dont knw this new rule until my wife visa got refused.

rule came on 16th august that any 1 applying for more than 6 months visa need TB medical certificate.

I fillied online on 3rd september
sbmitted the form at VFS on 13th september

got documents back on 03rd Oct - visa refused.

Now what is my options ?

can any one pls help me out.

Sorry to hear that. but this rule is been there from quite a long time, you should ask here or any lawyer to double check the requirement before submitting the application.

Any way, without beating the bush, your dependent need to get the medical certificate, and its up to you to go with appeal (if they give it to you) or new application.

I was thinking to renew my Tier 1 early, so that i'll get 3years and then take TB screening certificate and apply.

Hope they wont bring any rule by that time....

May I ask from where your dependent applied for visa, I mean which country? Per as my understanding if your dependent applied from Pak. or India even Gerry fedex not accept your application without TB certificate when you submitting your application.

I have applied from INDIA.

I know, VFS has to stop my wife application as there is no medical certificate.
but unfortunatily they did'nt say anything when she applyed but when i queried them later...

i got response from them saying : VFS nor its staff are authorised to suggest/advise the applicants on the supporting documents to be furnished. It is the responsibility of the applicant to go through the publisded guidance.

1.Main Applicant Passport Copy
2.Main Applicant Visa Copy
3.Employment Letter from Main Applicant
4.6 months - Payslips
5.6 months Bank Statement - Minimun 90days..

balance = 900 + 600(each depended) = 1500 ( last 90 days) if u leavin in UK for more than 2 years

otherwise

balance = 1600 + 900 = 2500 ( I dont exactly know this balance as i fall in above catagory pls check with some1 else if u leavin in UK less than 2yrs)


6. Marriage Certificate, Marriage photos, invitation card

7. I came few months after my marriage n here in uk for 3 months so
i have submitted telephone bills - proof of intouch with my wife

8. Tenency Agreement, Last month elec & gas bill on my name

9. Letter from me ( inviting my wife )

10. Letter from my wife ( applying for visa )

11. 74k fee take cash to VFS - make sure u take 80k, they charge for few otherthings.. pls make note some1 also try to sell Oster card for 4k dont take that

12. TUBERCLOUSIS MEDICAL CERTIFICATE PLS PLS PLS PLS ....

if you from Andhra prades then there are two centres...
1. Himayat nagar
2. Secandrabad ( heard this is gud)
Charges 1500 Rupees

13. Application form - Need to Fill on web and print it

Many Thanks Sadiq for your prompt reply. I have few more queries and hoping you will be able answer those.

1. Do I need to sign ALL the pages of Main Applicant's Passport ? Is it Mandatory ?

2. Do I need to high-light salaries (using markers) in Bank Statements (like we did for Tier 1 Visa Extension) ?

3. My Utility / Council bills does not display Full Name only display like Mr K Nagarajan. Is this suffice & will it have any impact for visa application ?

4. Could you please share invitation letter (Inviting Wife) I sent my email details via IM ?

I am not the expert, my view are below

1. You dont need to sign any copies of your passport - if your wife name there at the last page ( plus point) but even that not required.

2. You Dont need to highlight the salary I guess.
( Employment letter should have your salary right ? & you should be attaching payslips)

3. Even my utility bills Display my surname : Mohammed
( and you might be aware 99% muslims does hav Mohammed as surname)

4. I have send you sample letters to get an idea.

I am working in UK for the past 2 years.

I want to apply dependant visa for my child from india.

There are couple of clarifications

1. Whether TB certificate is required for child?
2. I don't have any utility bills in my name yet. Is that going to be a problem. Because i stay in shared accommodation and House owner pays all the bills in her name (council tax, water, electricity etc..). However i am getting a new tenancy agreement for my newly rented flat. Is that fine?
3. Do i need to provide any documents for confirming that i am living in UK for more than 12 months?
4. I am having 5 lakhs in my indian bank account. However after the statement got generated, i am planning to withdraw around 2 lakhs, which means i wont have the amount shown in the statement submitted to UKBA, but will have more than the required funds. Is that fine?

1. If age is greater than 6 then yes. I have seen it in UKBA site , verify it
2. New rental agreement is fine
3. No. Your entry stamp will say that.Morever it is in their system.
4. Better not to disturb your fund until you get the visa.

Firstly Sorry i was sick and had no time to reply.

1. When i was reading about TB screening documents, I found that tb certificate required for Childrens too.
If there are too young like babies then they required some sort of letter from the UK registered TB screening center mentioning, the parent are free from TB and baby is healty and no one in family has TB so os... please read the PDF for TB.. i dont hav 1 but u can search at ukba website....

2. UKBA requirement list does not mention anything about house aggrement or bills etc.. ( VFS will ask you all this )
If i was you.. ( i will apply with new Agreement & also a letter from landlord that he is paying all bills & ask ur landlord to give you the bills.. anyname... just to proof you leave there)

3. you dont need to provide any proofs for 12 months... ( you providing 6 months bank statement & payslips) - i guess ur employment letter also say's your working from so so....

4. Dont have any idea how they verify the india responses... I dont think so this will be an issue if u took any money out from the account...

( for ex : if you supply ur statement from UK bank does'nt mean u keep like that... offcourse money in and out will happen...

All they need... what ever you supply that should be original..and also the minimum required should always be there...

even i advise you not to disturb your account by withdrawing... as wen u applying you might be showing 5lakh = 3333 (something equal to pounds)

but who gone tell UKBA that 3lakh= ???? ( equal to ?)

leave it... application process will not take more than 3 weeks...
