ILR for my 5 month old son

Hi All,

I am applying for ILR next month for myself (General Tier 1) and my wife. We have a 5 month old son for whom we applied and received Indian passport. My wife and son need to travel to India in Dec this year. Do I need to apply for my son's ILR too?? or can he travel to India without any visa's at all and then apply for his British passport from India directly.

Only a British citizen can apply for a British passport.

How long will the child be staying in India?

I thought once we get our ILR. Then we can apply for his British passport in India

Well, you thought wrong. No British passport without first registering the child as a British citizen.

Moksh4me,

You have formed an incompleted picture of your child's options.

If your child was born in UK, once you get your ILR, then your child can 'register' as a British Citizen, only after which your child can apply for British Passport.

You will have to do some research on where/how and options.

Yes understood. The thing is my wife and son need to travel to India in Dec. So I will be applying for son's ILR too.
