EEA4 date getting close ??

Post by juju1979 » Fri Oct 12, 2012 9:46 pm

Hi there anyone who may remember me, quick summary
British citizen married to moroccain 7yrs now, granted EEA family permit in Italy April 2008, moved to Scotland 28th may 2008, I started work on the 18th June 2008 and been working the same job ever since and now have 2 beautiful girls.
We know that from the 28th may next yr my husband has been here for 5 continous yrs and he can apply for confirmation of PR but now that we have been married for 7 yrs can my husband not straight away apply for citizenship without the confirmation.
And also does he apply for PR from when he entered the country and passport was stamped or does he have to wait for the issue date of his residence card in 2009.
Any help will be much appreciated

You were already moved to the right forum.

On or after 28/05/2013.

He will need to pass Life in the UK test. He could either apply first for PR Confirmation (using form EEA4) and then naturalisation or straight for naturalisation with the same evidence required for EEA4.

He will need to prove (again) that you exercised treaty rights in Italy and that he lived there with you. He will need to prove he lived in the UK for 5 years (to prove he got PR under EEA regulations. For naturalisation part of the application just the last 3 years are relevant). What you did in the UK is irrelevant.

So I will start preparing for it now which I don't think will be a problem as I have most of it from applying for the eea2 residence card.
And am I correct in thinking when it passes the 28th may he is clear of all immigration aswell

We live in the Scottish borders and my husband has done the ESOL access 3 in english and passed also having certificates to prove it, would that stand for the citizenship and bypass the Life In The UK Test.
