Dependant visa for a uk born child

Post by redbull110 » Fri Oct 19, 2012 11:04 pm

Dear Moderators and Senior Members,

My child was born in the UK earlier this year but since my wife was on PSW and her visa was running out, so he travelled along with my wife to back home.

Now when I applied their dependant visa, my child's visa was refused and the following was quoted:

"Whilst I acknowledge that you have a parent (father) present in the United Kingdom as a PBS migrant, you have provided no satisfactory documentary evidence such as a court order to show that your sponsor has sole responsibility for your welfare. I am therefore not satisfied that both of your parents are either lawfully present in the UK or being granted entry clearance or leave to remain at the same time as you. 319H (f)"

Can you please help me that what I need to do in order to get any document ready to show that I can solely bear the welfare of my child.

Many Thanks.

Regards,

Redbull110.

Is your wife intending on applying as your dependent?

Dear Greenie,

She did apply as well and they refused her and my child application on Maintenance even though I sent bank statements from two different banks as from one of the bank the balance was not properly maintained.

Thanks.

Would suggest you reapply once you have the required funds as you are not going to be able to choose you have sole responsibility for the child in these circumstances.

Thanks Greenie.

As I have required funds available in my savings account and if I re-apply and attach those bank statements, then you saying that they will not raise this point for my child application?

Not if your wife is also applying at the same time.

Yes, my wife and my child are both applying at the same time. So I would take that if she is applying at the same time along with my child with no issues at all with the maintenance, then I do not need anything else to proof the sole responsibility?
